Crystal Township Board Meeting
February 13, 2019
7:00 p.m.
Crystal Community Center

 

The meeting was called to order by Supervisor McCracken at 7:00 p.m. and followed by the Pledge of Allegiance. 

Members Present: McCracken, Bahm, Siburt, Baker-Marek, Kutt
Public Comment: Public was allowed time to make comments.

Approval of Agenda and accepted the Consent Agenda: Motioned by Siburt, seconded by Baker-Marek to approve the agenda. Motion carried-all ayes.

Approval of the Consent Agenda: Motioned by Bahm, seconded by Kutt to approve the Consent Agenda.  Motion carried-all ayes.

Reports:
Montcalm County: C Johnston- Meetings have been changed to 4th Monday of each Monday at 6:00pm. There has been a 2% raise for all non-union employees.
Fire: SBrundage-8 Runs total in January.
Sewer: S Brundage-Generator failed during the ice storm, up to $4,000 to get repaired. Motion by Baker-Marek, seconded by Siburt to authorize up to $5,000 for generator repaid.  Motion carried-all ayes.
DPW: R Gooding- Community Center had leaks again during the melting last week.
Duck Lake Improvement: D Wight-Next meeting will be April 8th.
DDA: D Wight- Crystal Winterfest took place 2/9/19 and was very successful. There were over a dozen planes landing on the lake. ATV races took place on the north side of the lake with bringing many spectators to the area. More activities held in the community center for the children. Also the free movie had over 200 attendees.
Montcalm Police Report: Monthly Report was read by C McCracken, 28 investigations.
Community Center Committee: All meetings have been cancelled due to weather.

Correspondence: Monthly Correspondence was presented.

a.  Park Redevelopment/5yr Rec Plan presentation by J Sheets

b.  Marijuana-Motion by Siburt, seconded by Kutt to Opt out of Recreational Marijuana. Motion carried-     ayes-all.  Baker-Marek will get with attorney to propose an ordinance.
c. Deputy Treasurer-Motion by Baker-Marek, seconded by Bahm to increase the Deputy Treasurer wage by $325 for this fiscal year. Motion carried, ayes-all.
d. MTA Conference, April 2nd-4th-Motion by Baker-Marek, seconded by Bahm to pay for Kutt, Siburt and Baker Marek to attend. Motion carried, ayes-all.

     a. Assessor Resolutions          

i.                     Resolution #02132019B

CRYSTAL TOWNSHIP

           GUIDELINE RESOLUTION FOR POVERTY EXEMPTION

WHEREAS, the adoption of guidelines for poverty exemptions is required of the Township Board;

and

WHEREAS, the principal residence of persons, who the Supervisor/Assessor and Board of Review determines by reason of poverty to be unable to contribute to the public charge, is eligible for exemption in whole or in part from taxation under Public Act 390 of 1994 (MCL 211.7u); and

WHEREAS, pursuant to PA 390 of 1994, the Township of Crystal, Montcalm County adopts the following guidelines for the Board of Review to implement. The guidelines shall include but not be limited to the specific income and asset levels of the claimant and all persons residing in the household, including any property tax credit returns, filed in the current or immediately preceding year; To be eligible, a person shall do all the following on an annual basis:

1) Be an owner of and occupy as a principal residence the property for which an exemption is requested.

2) File a claim with the supervisor/assessor or Board of Review, accompanied by federal and state income tax returns for all persons residing in the principal residence, including any property tax credit returns filed in the immediately preceding year or in the current year or a signed State Tax Commission Form 4988, Poverty Exemption Affidavit.

3) File a claim reporting that the combined assets of all persons do not exceed the current guidelines. Assets include but are not limited to, real estate other than the principal residence, personal property, motor vehicles, recreational vehicles and equipment, certificates of deposit, savings accounts, checking accounts, stocks, bonds, life insurance, retirement funds, etc.

4) Produce a valid driver’s license or other form of identification if requested.

5) Produce, if requested, a deed, land contract, or other evidence of ownership of the property for which an exemption is requested.

6) Meet the federal poverty income guidelines as defined and determined annually by the United States Department of Health and Human Services or alternative guidelines adopted by the governing body providing the alternative guidelines do not provide eligibility requirements less than the federal guidelines.

7) The application for an exemption shall be filed after January 1, but one day prior to the last day of the December Board of Review.

The filing of this claim constitutes an appearance before the Board of Review for the purpose of preserving the right of appeal to the Michigan Tax Tribunal. The following are the federal poverty income guidelines which are updated annually by the United States Department of Health and Human Services. The annual allowable income includes income for all persons residing in the principal residence.

 

 

NOW, THEREFORE, BE IT HEREBY RESOLVED that the supervisor/assessor and Board of Review shall follow the above stated policy and federal guidelines in granting or denying an exemption, unless the Board of Review determines there are substantial and compelling reasons why there should be a deviation from the policy and federal guidelines and these reasons are communicated in writing to the claimant.

TOWNSHIP/CITY HOUSEHOLD INCOME STANDARDS TO BE ELIGIBLE

                                                                           FOR A POVERTY EXEMPTION

(PA 390 of 1994 states that the poverty exemption guidelines established by the governing body of the local assessing unit shall include an asset level test)

 

The Township/City has adopted the following standards for the 2019 year, for a household to be eligible for a poverty exemption. Below is the chart for size of family, chart is based off of the U.S. Federal Poverty Guidelines.

RESOLUTION TO ADOPT ALTERNATE START DATES FOR MARCH 2019, JULY 2019 and DECEMBER 2019 BOARD OF REVIEW

Motion by Bahm, supported by Baker-Marek to adopt the following resolution:

To adopt the alternate start dates as follows:     

For the March Board of Review, second meeting in March which can be either the Tuesday or the Wednesday following the second Monday in March.

For the July Board of Review, an alternate date during the week of the 3rd Monday in July.

For the December Board of Review, an alternate date during the week of the 2nd Monday in December.

RESOLUTION TO ADOPT PROCEDURES FOR GRANTING AND REMOVING REAL PROPERTY EXEMPTIONS

Motion by Baker-Marek supported by Siburt to adopt the following resolution:

To adopt procedures for granting and removing real property exemptions as described in Chapter 6: Property Tax Exemptions, Abatements and Tax Capture Authorities of the State Tax Commission Manual, Bulletin  of 2016 (Senior Citizen & Disables Family Housing Exemption), Bulletin 26 of 2017 (Charitable Exemption), The Michigan Strategic Fund Board designates Tool and Die Renaissance Recovery Zones pursuant to MCL 125.2688d & Nonferrous Metallic Minerals Extraction Severance Tax Act, (Act 410 of 2012) as attached hereto making them part of the resolution.

RESOLUTION TO ADOPT WAIVER OF INTEREST AND PENALTY FOR PROPERTY TRANSFER AFFIDAVITS

Motion by Bahm, supported by Baker-Marek to adopt the following resolution:

To adopt the waiver of interest and penalty for property transfer affidavits (PTA) as follows:

WHEREAS, The Michigan State Tax Commission has published in the most recent guidelines for the next AMAR (Assessing Minimal Audit Requirements) audit cycle that included a review of the compliance of charging a fee for interest and penalty under 21.27b for not timely filing form 2766, or the adoption of a resolution to the contrary; and

WHEREAS, MCL 211.27b requires a penalty to be assessed to the buyers of properties if a Property Transfer Affidavit is not filed within 45 days of any transfer of ownership; and

WHEREAS, MCL 211.2b (1c)(1d) defines the penalties by state statute; and

WHEREAS, the AMAR audit provides for a resolution to waive penalties as deemed necessary; and

Now Therefore be it resolved that the Township will adopt the penalties defined by MCL 211.27b (1c) (1d);

And furthermore, that the interest and penalties may be waived at the discretion of the Township Assessor.

b. Spring Clean Up- will be set for the first week of June 2019.
c. DPW Seasonal Position- Motion by Bahm, seconded by Baker-Marek to hire David Cavanaugh at $10       per hour to the Seasonal DPW Position. Motion carried, ayes-all.
d. Township Investment Policy-Draft copy to board for review.
e. Fire Chief position:  Motion by Baker Marek, seconded by Siburt to appoint M Fitzpatrick to the Fire Chief position.  Motion carried, ayes-all.
f. Sidney Bank Proposal- discussion:  to review a list of all accounts and to get written offers from other banks comparing rates and costs.
g. Library Book Sale- Motion by Siburt, seconded by Baker-Marek to allow the Friends of the Library to leave the books in the room in the community center to allow them to have the ongoing book sale. They are asking for 1 to 2 days in advance to remove the books if the room needs to be vacated.  Motion carried, ayes-all.

Pubic Comment:

K Siburt: Solid Waste committee is looking at having a county wide Shred Day/Electronics/Household Hazardous Waste and Hazardous Waste events.

G Bakker:  Remember Chemical Bank made a huge donation to the Township-the building to the DDA.  Should ask for a bid before deciding, compare rates.

Motioned by Baker Marek, seconded Bahm to adjourn at 8:33.  Motion carried, ayes-all.
